The danger when political parties assimilate the duties of government

While it rarely becomes top of mind for voters, there are times where political parties attempt to take on some of the responsibilities of governments, either because they don’t trust government agencies to perform these duties, or they perceive some form of electoral or financial value in doing so.


Now I can’t speak for their intentions, and it may seem benign that a political organisation ‘helps out’ by conducting the arduous job of encouraging people to provide their views on a complex governance issue, of collecting and collating these responses and then presenting them to the government of the day for consideration, but I’d like to quickly highlight some of the perils in this approach.

Firstly it is important to recognise that governments and political parties are separate organisations. Political parties are privately owned and run for the benefit of their members, whereas government has a responsibility to the entire community and is, in effect, owned by all citizens. As such their motivations and interests can be extremely different at times, even when politicians from these political parties are elected to parliament and serving as the government of the day.

One of the most striking differences is in their financial motivations. Political parties attract funding from donations, investments, events and membership fees and are constantly looking for additional funds to help them build their structures and campaign more effectively during elections. They operate like private companies with limited scrutiny over their books. Governments operate in an environment of much higher public scrutiny and accountability. You have a right to see how your governments is collecting, employing and disbursing its funds - but no such rights of oversight over the political party that your elected officials belong too.

Similarly governments have certain obligations around privacy designed to protect individuals from undue government interference (noting people may debate whether these go far enough or are equitably enforced), whereas political parties, through the machinations of their elected parliamentarians, excluded themselves from the provisions of Australia’s privacy law. This means they can collect and combine data about any citizen without scrutiny or oversight and citizens have no right to ask what private information political parties hold on them, let alone to correct this information should it be incorrect.

These two areas of difference in combination, financial and privacy, lead to very different motivations and approaches between political parties and governments. For example as there is no requirement for a political party to act in an unbiased manner, it may favour engagements with citizens who pay them more money, via ‘donations’, or who they feel, from the information they hold on them, are more receptive and likely to vote for that party’s candidates to form government.

Governments are not allowed to show such bias, and there can be significant consequences when they do, creating a constant tug of war for elected politicians whose loyalties are divided between their party, serving their big donors and supporters, and the state, serving all citizens on an equitable basis. 

This tension can be managed to some extent in governments, where the public accountability requirements reveal inequitable activities by politicians and provide methods for injecting more balance, or censure - although most politicians do skim as close to the line as they can.

The tension cannot be managed however, when political parties take on roles that government usually performs. Instantly that public accountability disappears and politicians and their parties have a different set of motivations in play, based on party gain rather than public good.

Even when politicians are public minded and seeking to do the right thing, that’s no guarantee that their party machinery, which answers only to itself, not the public, will not use these opportunities to just bias the process a little in their favour.

This is where I come to the example of the ACT Liberals and their role in a public consultation process.

Any individual or organisation can choose to promote a public consultation (I regularly do this myself) or provide a free service where it provides forms for collecting responses, aggregating and submitting them to governments. There’s some notable groups doing this today - including activist and lobby groups like GetUp and the Australian Christian Lobby, retailers like EB Games which provided a response and submission mechanism during the consultation on R-rated games, and industry bodies such as the Australian Mining Council which regularly collects and submits the aggregate views of its members in relevant consultations. Change.org and similar services allow individuals to undertake this appproach in a similar manner - though more linked to petitions than consultation responses.

These groups are all entitled to take these steps, and generally do so in order to promote their ‘side’ of views. The extent to which they will entertain and pass on divergent views differs by organisation, but if you wish to take the chance they will not pass on your response, that’s your decision to make.

Political parties differ slightly when doing this. Firstly they exist outside the privacy act,  are expected entitled to keep everything you say and add it to their file on you, helping them decide down the track whether you are someone they wish to cultivate for donations or would consider helping in a governance matter. As they are exempt from privacy law and  privately owned, there isn’t no scrutiny on whether they modify your submission, aggregate it with others in deceptive ways to push their point or simply withhold it from government altogether.

At the same time the public expectationsof political parties are much higher. If your local member asks you to provide feedback on an issue via their website it can convey the appearance that you are directly responding to the government and thus have the public probity rights you should expect when responding on an agency website, even though you don’t.

This can easily mislead voters with a more limited understanding of our political processes, who trust their elected representative to behave according to government requirements.

In the case of the ACT Liberals there was also the matter of 19 misplaced responses which were caught in a spam filter. 

Tragic to say this has happened at government agencies as well, and I have direct experience of helping agencies resolve this technical problem. 

While it is the headline of the Canberra  Times article, I regard this as less of a concern than the ability of the party to select or reinterpret the responses it passes to government, while keeping all the details of every response in their citizen database for future electoral advantage.

This is a single example of the risks of political parties taking on government responsibilities but serves to illustrate the broader issue. When duties move out of government to party machines we love the ability for public accountability, the tasks are performed by individuals without a contractual and cultural commitment to be apolitical and the motivations change to be less equitable and more ideologically driven.

Whether it is collating consultation responses, negotiating trade agreements, advising the Minister on complex matters, making purchases, providing services or otherwise transferring a government process to a political party team, or some other task, we lose as a democracy when political parties absorb or deliver more of the functions of government.

Even when the intentions are good, corrupting the approach is far easier and less accountable and it undermines our nation when this occurs.

How modern democracies face destruction if they can't stop building digital Maginot Lines

The recent revelations in the media about the collection of personal information from up to 87 million Facebook users by Cambridge Analytica and its use to influence political outcomes (successful or not), should be sending chills down the spines of everyone involved in information security, privacy and governance.

That people's data can be appropriated and used to manipulate democratic processes is a clear threat to the basis of democracies around the world - and governments appear to be flailing on what to do about this.

Now certainly corporations, such as Facebook and Google, have both legislative and business reasons to protect personal data. It's their lifeblood for making profits and without a sufficient level of public trust to keep people using these services these companies would largely disappear overnight.

However governments also have a responsibility to safeguard their citizens, and their own institutions, from external manipulations of their democratic systems - whether this come from foreign states, corporations or even particularly influential groups in society.

While Facebook is responsible for allowing a researcher to create an app that could such down the personal data of many people, even without their consent, it may not have been illegal for Cambridge Analytica to do this (although their subsequent use of this data for electoral manipulation may have been), and while Facebook may be investigated for privacy breaches, the consequences to Facebook and Cambridge Analytica appear to be more social than official to-date.

For me the spotlight is more on governments than the corporations involved. Laws exists to provide a legal basis for managing anti-social behaviour and power imbalances (such as between large organisations and individuals) such that the basic unit of the state, the individual citizen, has their personal rights protected and has clarity about their obligations as a citizen.

In this case governments did not have the laws and frameworks in place to detect, limit or even rapidly prosecute massive breaches of personal privacy or attacks on their own institutional validity.

Governments that cannot protect themselves or their citizens from external influences - whether these be physical or digital - do not remain governments for long.

I see the Cambridge Analytics scandals as another in a long series of examples as to how modern democratic governments have failed to put appropriate mechanisms in place to protect citizens and themselves from modern threats.

Like the Maginot Line built by France in the 1930s, governments are investing in expensive, unwieldy and inflexible infrastructures for past threats. And, like the Maginot Line in 1940, these infrastructures have proven again and again that they fail in the face of modern agile opponents.

Thus far the reaction by governments has largely been to acknowledge failure, promise to do better and then return to investing in legacy infrastructure, attempting to modify it as cheaply and as little as possible to address modern threats.

From the cascading series of security breaches at scale, rising digital interference in western elections and undermining of democratic institutions - I think the evidence is clear that the strategy is failing.

So what are governments to do? How do they adapt their approaches to address a threat that can come at any time, through any channel and often targets civilian infrastructure rather than state-controlled infrastructure?

The first step is to recognise that their current approach is not working. The political and commercial opponents seeking to weaken, influence, manipulate and destroy western states do not limit themselves to playing by western rules.

The second step is to recognise that this isn't a problem that governments can solve alone. Protecting government infrastructure is pointless if power grids and financial sectors are manipulated or destroyed. If a hacker wants to shut down a government office it is often easiest to cut their power or payroll than attack the government's servers directly. In the longer-term the public can be turned against a government through social media engagement using fake news and slanted reports.

The third step is to redefine what constitutes the state and what it values. Government is a tool used to govern a population. It is a component, but not the only, or even the most essential, in defining a nation's character or values.

Then, we need to rebuild our thinking from first principles. What do we value, and what do we not value? What conduct is appropriate, and by whom? How do we protect freedoms for citizens while defining their responsibilities? How do we educate citizens to understand that they have an active ongoing role and responsibility to help maintain our freedoms - that their obligation doesn't stop at a ballot box every few years? How do we redefine the role of corporations and other organisations (including government agencies) as good organisational citizens in a society? What are their rights and obligations towards citizens, stakeholders and shareholders?

This doesn't mean turning western democracy into security states. In my view the growth of state security apparatuses is a poor solution, part of the Maginot Line of centralised control that is failing so badly to protect democracy from a swarm of diverse threats. Indeed, the idea of decentralising security in favour of emphasising personal responsibility through education is, in my view, the best course to protect our nations' values.

We need an inclusive approach, backed by sound principles and collective values, that preserves what is important to our societies and inoculates us from unwanted external influences.

Without this we will lose who we are in protecting what we want - turning us into authoritarian states, the mirror of our enemies.

It's time to provide feedback on Australia's Open Government Plan

Last week the government released Australia's draft Open Government National Action Plan, a requirement to join the international Open Government Partnership, for community consultation.

Australians have until the 18th November (Edit: extended from 14th based on community feedback) to comment on the plan, at which stage the government intends to move to rapidly endorse it via Cabinet and begin implementation.

The plan is available as a PDF download from the government's Open Government Partnership website (ogpau.govspace.gov.au) as well as in web format (much easier to read) at the civil society Open Government Partnership Network site (opengovernment.org.au).

I've included the 14 commitments proposed below in brief - for more detail click through to the sites. (Edit: thanks to Asher for corrected number).

Transparency and accountability in business

The Government will enhance Australia’s strong reputation for responsible, transparent and accountable business practice. 

Open data and digital transformation 

The Government will advance our commitments to make government data open by default and to digitally transform government services. 

Integrity in the public sector  

The Government will improve transparency and integrity in public sector activities to build public confidence and trust in government. 

Public Participation and Engagement

The Government will improve the way the Australian Government consults and engages with the Australian public.

Have you been pawned? What could Australian governments do to reduce the frequency of data breaches

Data breaches at major organisations have become a weekly event, but don't always make it into the public eye for months, or even years, after they happen.

This is both because it can take some time for an organisation to become aware it has been breached and because few organisations are forthcoming about security concerns.

This lack of willingness to communicate breaches can be because many fear a loss of respect or trust if they admit a breach has occurred, and in certain cases companies may even be liable for fines or damages in a class action.

Of course, not declaring breaches can also come with a sting in the tail. Individuals might find some of their other accounts become compromised, or experience monetary or identity theft - in extreme cases people can find themselves in debt, their property sold, or even be gaoled.

Governments in Australia have been slow to put measures in place to protect citizens in these circumstances - even forcing citizens to take them to court to rectify these situations, as a Canberra homeowner recently had to do.

Unfortunately in Australia it's not even mandatory for data breaches to be reported, so there's limited information about how widespread the threat or cost actually is, making the situation even harder to deal with.

I subscribe to a service (Have I Been Pawned?) that alerts me when a service I use is reported as hacked - but even this is largely limited to international online services and it remains very slow to discover when these hacks occurred.

The example below shows how Dropbox has only in the last few weeks acknowledged a hack in 2012 which exposed the details of over 60 million people - that's more than twice Australia's population. Their information (including mine) has been traded online by the hackers.

Now some people might consider this a normal part of living and doing business in the internet age - but should we?

There's a number of steps that both governments and commercial organisations can take to reduce the impact of these types of breaches and help ensure they occur far more rarely.

The first step is a mandatory requirement to publicly notify everyone who may be affected by a breach within a week of it being detected, with a mandatory public announcement of the breach within two weeks.

If the notification is made on a timely basis, organisations should not face a significant fine from the government, but if notification is late, they should face a fine equivalent to a significant portion of their gross income for the previous year.

Where organisations are breached, they should be legally required to, at their own cost, identify the cause and rectify it, putting in place appropriate security measures to prevent recurrence and fix any other identified security issues with their system.

Organisations should also be put on a three-year watch list, where if they suffer another breach and cannot demonstrate that they maintained their security infrastructure to a sufficient standard, are subject to that very significant fine detailed above.

This should apply across both private and public organisations - with government agencies held to the same high standard of conduct. In fact it could be argued that government should be held to an even higher standard due to being required to maintain public trust and how certain agencies may compel information from individuals and store it for their lifetime.

Governments should also set up positive security regimes, where people are rewarded for identifying and reporting security holes in government properties. Corporations could also be provided with incentives to do the same, such as subsidising rewarding and rectifying appropriate security issues in a similar way to R&D subsidies.

The government needs to work with governments around the world to ensure that laws punishing identity theft - fraud - are sufficiently strong to create a strong disincentive for anyone who might be caught either perpetrating a hack or benefiting from it. There's already a base in place for this, but there's ways to strengthen it and treat identity theft with the degree of severity it requires.

Finally governments need to ensure they are appropriately educating citizens through a variety of channels - providing educational content, ensuring that no government agency allows users to create weak passwords, training their own staff (essential for national security), training police forces to understand and engage appropriately with citizens who report identity theft and rewarding companies who educate their staff and customers for reducing the overall risk.

Now it is important to be realistic about the situation. Australians use a variety of foreign online services and it is impossible to secure them all, all of the time. Hackers will find ways in via mistakes in ICT configurations, slow maintenance, zero day exploits and social engineering.

However the incident and severity of the data breach risk can be greatly reduced if Australian governments stop turning a blind eye to the issue and begin seriously engaging with it.

At minimum governments need to broaden their cyber security policies to recognise that it's not just the government itself at risk. From here, there's many opportunities, such as those described above, for governments to be more proactive about protecting their citizens from the risk of data breaches, from enemies both domestic and foreign.

How much will Australians pay for the openness and transparency we expect from our governments?

In business if no-one will pay for a product it ceases being made, or never gets off the drawing board.

Government doesn't quite work the same - many government functions and services are designed as 'public goods' - things we all need, but that many 'customers' cannot or would not pay for.

This includes services such as national defense, law and order, welfare, health care and education.

Democracy is also a service and comes at a cost - as does openness and transparency in government.

It costs money to hold elections, to release documents and data, to provide independent watchdogs that address citizen complaints, monitor agency activities and investigate corruption.

In fact measures that reduce democracy or government transparency sometime receive public support from citizens. Often this is because the consequences are not fully considered or, in a few cases, some of these individuals actually benefit from less democracy or transparency.

Many dictatorships get their start from democratic states where citizens are unwilling to invest in their own freedom and democracy. Governments on this track may gradually reduce what is visible using an economic cost argument, and foster a 'political class' that values cost-effectiveness over public good.

We've seen some of this over the last few years in Australia, with the situation of the Office of the Australian Information Commissioner being a prime example. The (much reduced) Office is now being sustained on a 3-monthly basis grudgingly by the Attorney-General, who lacks the parliament's approval to close it  down.

However it's not simply governments who aim to provide transparency into governments. There's a range of non-government organisations working in this space as well, from Transparency International to the Sunlight Foundation and Open Australia.

All of these organisations rely on funds to operate - transparency isn't free - and in Europe and North America there's well-established donors and systems for funding these groups to effectively carry out their roles.

Australia lacks these donors and systems and, it appears, even our governments are not interested in funding these independent organisations.

One such organisation is OpenAus. Founded and run by Rosie Williams out of Sydney, the service has taken a range of government data on budgets and charities and uncovered key insights that have never before been visible to the Australian public.

Rosie's work has been featured in numerous media outlets and attracted positive attention from some of the highest officers in the Australia Public Service.

However there's little in the way of funding available for this type of work in Australia. As Rosie says in her latest blog post,

There is no eco-system providing financial support to transparency projects. Projects like mine tend to veer away from government funding (to remain independent politically) and do not reflect the priorities of the venture capital ideology. As such there is a funding challenge in grassroots transparency projects in Australia that can only be filled by the citizens.

Rosie has reached out to a range of potential funding sources, but come up largely dry. Her current work has been funded through the New Enterprise Incentive Scheme (NEIS), a nine-month business building program which is set at the payment level of the dole. This is hardly sufficient to fund an individual, let alone grow a business.

Rosie will shortly finish NEIS and, having attracted only $1,500 in donations for OpenAus, is likely to have to transition back into a normal programming role.

Even if she maintains OpenAus alongside a full-time job, it will be much diminished - as will Australian government transparency.

Contribute now to Australia's Open Government Partnership National Action Plan

Now that Australians are heading out of holiday mode, it's a good time for a reminder about the Australian Government's process to become a member of the global Open Government Partnership (OGP), through developing our first OGP National Action Plan.

If you've not heard of the Open Government Partnership, in a nutshell it's an international group of governments and civil society organisations committed to progressing open and transparent governance in the 69 participating nations through a cooperative and supportive process.

Each nation makes a commitment to improve their national government's openness and transparency through a statement by their government, supported this through a two-yearly National Action Plan (NAP) with priority activities relevant to the nation's development stage. These NAPs must be developed cooperatively between government and civil society through an active consultation process.

Nations are assessed annually on their NAP progress through an independent process, with their achievements and shortfalls highlighted internationally.

Australia was invited to become a founding member of the OGP back in 2011, however deferred this decision until 2013, and then delayed it further after a change in government.

The current Prime Minister re-committed to the process late in 2015 and restarted the process to become an OGP member.

I ran a series of Information Sessions across Australia's east coast about this process, funded by the Department of the Prime Minister and Cabinet, and the presentation used through these sessions is below.



Currently Australia is consulting on the commitments that should be prioritised in our first National Action Plan, with Australians invited to provide ideas through the wiki (ogpau.wikispaces.com) or via email to ogp@pmc.gov.au

Improvement in governance is the goal, innovation and transformation are simply techniques to help it along

Over the last year in Australian government there's been increasing rhetoric around transformation (primarily digital) and innovation.

This has come both from the political level, particularly since Malcolm Turnbull became Prime Minister, and from the administrative level, as the Secretary's Board and an increasing number of senior public servants have internalised these terms within their approach to gain funding and support for their activities.

I'm a big support of innovation within government. Where government seeks to improve internal efficiency and external effectiveness, innovation - as a technique for exploring, testing and trialing new approaches - is a key strategy for achieving improvement.

In my view digital transformation is part of this innovation track, with a particular focus on using digital technologies, and the strategies and tactics they enable, to help improve governance and operations across the public sector.

As such both innovation and digital transformation are important techniques that should form part of the 'toolkit' of every public sector employee.

However, in all this rush to secure innovation rushing and transform service delivery via digital tools, public servants and politicians alike must ensure they focus on the goals they are seeking to achieve, not simply the (shiny new) tools they are using to achieve them.

The goal - as it has been for hundreds of years - is to improve the operations of government and ensure that, within the budgets available, governments deliver the best possible experience and, particularly, outcomes, for their 'owners' - citizens.

Innovation is not the goal, it is a method used to achieve the goal, whatever that might be.

Similarly digital transformation is a technique for shifting services between delivery or processing channels in order to deliver more convenient and effective outcomes for the service recipient, potentially with the secondary goal of a more cost-effective, reduced-error service delivery approach for the provider.

Within all the rhetoric abut innovation and digital transformation we've heard from governments, and with the large amount I expect we'll continue to hear this year, keep in mind the end goal - improving government efficiency and effectiveness.

Innovation and transformations do not, by themselves, improve government. They are simply techniques and can be implemented both well and badly, depending on the people, culture and environment they are employed within.

Indeed in certain cases innovation can make things worse - harder, slower, less reliable - or have unforeseen consequences that end up costing government more, and reducing its effectiveness overall.

So look for the outcomes of innovation and digital transformation.

Does an agency's innovation approach reduce costs, reduce error rates, increase satisfaction or improve outcomes for the services and systems to which it is applied?

Last year we heard the talk about innovation and digital transformation. This year we'll start seeing the first outcomes from some of the most highly funded agencies and offices tasked with these techniques.

This year, 2016, will be the test of whether government agencies in Australia are effectively implementing innovation, shifting their culture and administrative biases to facilitate successful innovation and resulting in real improvements in citizen welfare and government operations.

I hope we hear the successes shouted from the rooftops.

Silence can only mean that this has been a failed experiment, with senior public servants using innovation as a way to buffer declining budgets rather than make measureable improvements in how Australian government operations.

The future of intelligence is distributed - and so is the future of government

In 2011 an IBM computer, Watson, beat human competitors at Jeopardy! 

This was a new landmark in artificial intelligence - a computer capable of correctly responding to plain English questions, in real time, by figuring out their intent.

At the time Watson was a computer as big as a room, and it was the only one of its kind in the world.

The original Watson still exists, as discussed in this Wired article, The Three Breakthroughs That Have Finally Unleashed AI on the World, however it is no longer alone.

Hundreds of Watsons are now in operation - not as room-sized computers, but operating 'in the cloud', as distributed software across thousands of open-source servers.

People can access the intellect and computing power of these Watsons through any computing device connected to the internet.

Even more significantly, like many artificial intelligences, Watson is a learning machine that gets more knowledgeable and able to find insights the more it learns. Whenever a Watson learns something, making a new connection, that knowledge is shared with every Watson - making it a distributed intelligence, able to learn at rates far faster than even a single supercomputer, or human, is able to learn.

The power of Watson isn't in the revolutionary algorithms that power its learning, it's in the network itself - how separate Watsons can share knowledge and learn from each other.

This is how humans evolved civilisation - by capturing, codifying, storing and sharing knowledge in sounds, images and words to pass it on from one individual to another.

However Watson hints at a more robust future for human intelligence, and for how we govern ourselves.

Humans have proven over the centuries that having more learners with better knowledge sharing means faster progress and better decision-making. Books, universal schooling and the internet have shown how dramatically a society can progress when appropriate knowledge sharing systems are in place.

The key is to focus on the size and complexity of the networks, not the expertise of individual 'nodes' (you might call them humans).

For computers this means that the more Watsons we create, and the more complex the knowledge sharing between them, the faster they will learn.

For governments this means the greater the transparency, and the more informed citizens are participating in knowledge sharing, the better the decisions and outcomes will be.

Now this isn't how government is currently constituted. The notion of representative democracy is that governance is handed to experts and specialists who live and breathe government so the rest of the population doesn't have to.

We elect politicians who are supposed to representative the interests of their electorates, and appoint bureaucrats whose role is to provide specialist knowledge and operate the machinery of government - develop policy, design and deliver programs, enforce laws and support citizens in emergencies.

By its nature this approach to government relies on experts who are placed separately to the population - often even physically removed and concentrated in a city like Canberra, Washington, Ottawa, Brazilia, Naypyidaw or Putrajaya.

This group (elected and appointed public servants alike) tend to become inwards focused - focused on how to make government keep working, not on whether it actually works and delivers for citizens.

Particularly inwardly focused governments tend to become so removed from their citizens that they are overthrown - though they've usually replaced with a not-dissimilar system.

Now we can do much better.

Rather than focusing on electing and appointing individual experts - the 'nodes' in our governance system, governments need to focus on the network that interconnects citizens, government, business, not-for-profits and other entities.

Rather than limiting decision making to a small core of elected officials (supported by appointed and self-nominated 'experts'), we need to design decision-making systems which empower broad groups of citizens to self-inform and involve themselves at appropriate steps of decision-making processes.

This isn't quite direct democracy - where the population weighs in on every issue, but it certainly is a few steps removed from the alienating 'representative democracy' that many countries use today.

What this model of governance allows for is far more agile and iterative policy debates, rapid testing and improvement of programs and managed distributed community support - where anyone in a community can offer to help others within a framework which values, supports and rewards their involvement, rather than looks at it with suspicion and places many barriers in the way.

Of course we need the mechanisms designed to support this model of government, and the notion that they will simply evolve out of our existing system is quite naive.

Our current governance structures are evolutionary - based on the principle that better approaches will beat out ineffective and inefficient ones. Both history and animal evolution have shown that inefficient organisms can survive for extremely long times, and can require radical environmental change (such as mass extinction events) for new forms to be successful.

On top of this the evolution of government is particularly slow as there's far fewer connections between the 200-odd national governments in the world than between the 200+ Watson artificial intelligences in the world.

While every Watson learns what other Watsons learn rapidly, governments have stilted and formal mechanisms for connection that mean that it can take decades - or even longer - for them to recognise successes and failures in others. 

In other words, while we have a diverse group of governments all attempting to solve many of the same basic problems, the network effect isn't working as they are all too inward focused and have focused on developing expertise 'nodes' (individuals) rather than expert networks (connections).

This isn't something that can be fixed by one, or even a group of ten or more governments - thereby leaving humanity in the position of having to repeat the same errors time and time again, approving the same drugs, testing the same welfare systems, trialing the same legal regimes, even when we have examples of their failures and successes we could be learning from.

So therefore the best solution - perhaps the only workable solution for the likely duration of human civilisation on this planet - is to do what some of our forefather did and design new forms of government in a planned way.

Rather than letting governments slowly and haphazardly evolve through trial and error, we should take a leaf out of the book of engineers, and place a concerted effort into designing governance systems that meet human needs.

These systems should involve and nurture strong networks, focusing on the connections rather than the nodes - allowing us to both leverage the full capabilities of society in its own betterment and to rapidly adjust settings when environments and needs change.

We managed to design our way from the primitive and basic computers of the 1950s to distributed artificial intelligences in less than 70 years.

What could we do if we placed the same resources and attention on designing governance systems that suited modern society's needs?

And it all comes down to applying a distributed model to governance - both its design and its operation, rather than focusing on the elevation of individual experts and leaders to rule over us.

It's a big challenge, but for a species that went from horses to spaceships in two generations, it surely isn't an impossible one.

And given that societies thrive or die depending on how they are governed, are we willing to take the the risk and hope that our current governance and political systems simple evolve into more effective forms within a human lifespan?

Is government paying enough attention to privacy in its mobile apps?

Australian internet usage has just reached a tipping point, with more Aussies accessing the internet via their smartphones and tablets than via laptops and desktop computers.

This has been reflected in web usage statistics, with several agencies I talk to reporting that they now receive more of their website traffic from mobile devices than from desktop and laptop computers - particularly when excluding their own staff from the statistics.

There have also now been over 500 mobile apps designed, commissioned or reused by Australian government agencies and councils to deliver information, access services and report issues, including 69 apps from Federal agencies80 from Victorian government agencies22 from Queensland government agencies and many from local councils around the country.

There's even a few notable games, such as the ABS's Run That Town and Victoria's MetroTrains Dumb Ways to Die.

As a result there's an increasing need for agencies to pay attention to how they design mobile apps to ensure they meet appropriate accessibility and privacy standards.

The latter part of this, privacy, was the subject of a recent study and guide from the Office of the Australian Information Commissioner (OAIC) - Mobile privacy: A better practice guide for mobile app developers.

The guide reported that privacy was a key consideration for citizens, with a 2013 study by the OAIC finding that 62 per cent of Australians opt not to use smartphone apps because of concerns about the way personal information would be used.

The guide also mentioned a similar study in the US by the Pew Research Centre in 2013 that found that 51 per cent of teenage app users had avoided certain apps over privacy concerns, and over a quarter had uninstalled an app because it was collecting personal information they did not wish to share.

Now that's all fine when Australian governments are designing apps properly.

However the OAIC took part in an international 'sweep' on mobile app privacy back in May. As part of this the OAIC examined 53 popular free iOS apps, with a focus on apps produced by or on behalf of Australian businesses AND Australian Government agencies.

The OAIC found that a significant number of these mobile apps did not meet Australian privacy law requirements.

‘Of particular concern was that almost 70% of the apps we looked at failed to provide the user with a privacy policy or terms and conditions that addressed privacy prior to the app being downloaded’, Mr Pilgrim said.

The OAIC also found that almost 25% of the apps examined did not appear to have privacy communications tailored for a small screen.

Only 15% of the Australian-developed apps the OAIC examined provided a clear explanation of how they would collect, use and disclose personal information, with the most ‘privacy friendly’ apps offering brief, easy to understand explanations of what the app would and would not collect and use based on a user granting permission.

I'm sure the OAIC has privately fed back information to agencies on how their apps failed to meet Australian privacy and actions are underway to rectify this.

Other agencies and councils that have developed, are developing or have partnered with commercial mobile apps also need to be aware of the risks they are taking on if they don't adequately meet Australian privacy law.

Under the updated law that came into effect earlier this year, penalties for government agencies and corporations range up to a million dollars - making the omission of a privacy statement or use of user data without clear permission quite an expensive proposition.

Hopefully agencies are aware of the OAIC's report and are ensuring that user privacy is taken into account within their mobile apps.

If not, I hope we see some high profile examples to ensure that other agencies change their behaviour.

Young people in Australia are highly engaged in politics - but engagement has moved online. Have governments?

A few years ago I heard it said by political advisors that one hand-written letter to a Minister counts for more than 100 emails on the same topic.

The perception was that if someone sat down and wrote their thoughts in long-hand it showed more interest and commitment than if they typed and posted them online in a blog, social network or website.

I believe this has changed slightly, with emails now accorded almost equal status with postal mail (largely by treating them in the same manner as postal mail, which isn't always appropriate).

However the value placed on blog posts or social media commentary by both politicians and departments still remains far lower than the value that individuals using these channels place on their communication via these channels.

This discrepancy becomes particularly concerning when looking at the level of political activity amongst younger and older people in Australia.

Based on the 'traditional' forms of political engagement - joining political parties, participating in street protests, writing letters and otherwise using physical means to communicate political views - young people are generally considered unengaged, even disconnected, from politics.

This appeared to be supported by a recent study by the University of Canberra commissioned by the Museum of Australian Democracy. (reported on by the ABC and Hijacked)

This study found that, based on these traditional forms of engagement, young people were far less engaged than older people. In fact people aged under 35 were only about half as engaged as those over 70 years old, and were the least engaged of any age group.

However, the study went much further, looking at modern forms of political engagement - blogging, tweeting, memes, apps and other digital techniques - as well.

When combining traditional and modern forms of engagement the situation was very, very different.

Suddenly young people were just as engaged as the oldest Australians and more engaged than many of the age groups inbetween.


On this basis, including both marching in the streets and creating online petitions, young people are quite engaged in politics in Australia, with a large amount of their engagement occurring online rather than offline.

This can be hard for older Australians to grasp - they often don't understand the internet as younger people do, having been brought up on newspapers, radio and television.

Not coincidentally, a disproportionate number of our politicians, top bureaucrats, corporate leadership and leading journalists fall into these older groups - therefore they are often not equipped to even see, let alone understand, the ways in which younger people are engaging politically.

This divide isn't necessarily a problem, but it could become one. When insisting that young people follow the same political approaches as their elders, older people are devaluing newer forms of political expression and underestimating its reach and force.

Where politicians, departmental Secretaries and CEOs gauge the public's mood by signals such as how many people show up to protest, they may overlook the new signals, when hundreds of thousands, or millions, of people organise and protest online, until it is too late for them to change course.

There have already been examples of how politicians, media and CEOs have misread the public mood as they still rely on traditional, rather than modern political signals.

Until our 'elders' begin to recognise that times have changed and continue to change, they will continue to be blindsided as innovation continues in political protests.

For example, there was the creation of the Stop Tony Meow plug-in for Chrome, which replaces images of Tony Abbott in the web browser with pictures of kittens. The plug-in has been downloaded over 11,000 times and attracted significant media coverage as an anti-Coalition political statement.

There's also been the recent Dolebludger app available for Android mobile devices, which allows someone to send job application emails in a matter of seconds to 40 Coalition MPs, meeting the proposed monthly job application requirement. This was designed specifically as a political protest against a policy seen by the creator (and many public commentators) as absurd.

On top of this we have the endless string of memes created using free online tools which take photos of politicians and adds text to make a political point. These are then shared widely on Twitter, Facebook, blogs and other platforms.

And, more disturbingly, we've recently seen hackers take down a stock exchange and call on the nation's president to take action on a given matter under threat of having confidential financial data released publicly. Where did this last form of political protest occur? In Syria - a country not known as a bastion of democracy.

Similarly striking into illegal behaviour, we've recently seen the use of a phony bomb threat tweet to disrupt the flight of a Sony Executive as part of a protest against Sony's corporate behaviour.

Online political expression is evolving quickly, with new approaches emerging frequently and proliferating widely, if they work, or dying away when they don't.

The old view that people would get out on the street and protest if they were really unhappy is no longer supported by the evidence - and the notion that online activism is simply 'slacktivism' and doesn't represent significant numbers or strong views is equally no longer supportable.

Governments - both politically and administratively - need to build their understanding of modern approaches to political engagement and learn how to use and defuse them (as appropriate) to serve their own ends.

Otherwise there are real and growing risks that a government or public agency will be severely damaged or brought down through online political avenues - channels that they weren't effectively monitoring, didn't hold in high regard and catastrophically undervalued.

Why should governments continue to control voting systems and processes?

Having centralised systems for voting is the standard approach for countries around the world.

In most places it is simply accepted that the government funds the system for election and referendum voting - funding the polling places, ballot boxes, officials and vote counting systems, whether this be directly or at arms length via a body independent of government, but reliant on government funding.

And let's face it, voting is integral to governance. Voting provides legitimacy to a country's government, providing some form of mandate for a ruling party and ensuring that populations are satisfied with a given set of representatives by giving them a role in choosing them.

Looking at it cynically, having governments control voting could be seen as a conflict of interest - the politicians with an interest in re-election both create the electoral laws and fund the system for casting ballots.

Indeed in some parts of the world systematic electoral fraud is a major concern - the government can influence elections outcomes by changing the legal requirements for voting, adjusting electoral boundaries, place onerous condition on forming or operating new parties or on standing for election, limit electoral donations or advertising by opposition parties, or restricting physical access to ballot boxes.

That's before getting to issues with who votes, how many times and how the votes are counted.

In countries where there's substantial trust in governance and the electoral system these issues are generally small-scale, though ever present as we continue to see with voter identification laws introduced in some US states, major parties voting themselves more electoral funding (as Australia's two major parties tried to do in 2013) and individual examples of bad practice by candidates across all democracies.

In places where democracy is fragile and institutions are weak these issues are magnified, and various systems have been developed to keep elections honest - independent observers are often involved (where allowed) to scrutinise an electoral process; citizens and activist groups have photographed and published issues at ballot boxes online via mobile devices, first in ad hoc ways and then via map-based reporting systems such as Ushahidi; entire websites dedicated to exposing electoral fraud and bad practice have popped up around the world.

These systems have often migrated back to established democracies, for example, the mobile phone tool used to scrutinise the 2007 Kenyan elections was reused in the US Presidential race in 2008, demonstrating that in sustaining freedom to vote, eternal vigilance remains important.

However these are simply systems to scrutinise how governments run elections, rather than independent voting processes. They watch and report what happens in electoral systems, but don't seek to replace these systems directly.

Switzerland is perhaps unique in that it has an entrenched system of direct democracy which allows citizens to overrule parliament through a plebiscite vote - but even then the electoral process is funded and managed by the state.

More recently we've seen pseudo-electoral systems emerge - online petition systems like Change.org, which is having a material impact on government decisions. We've also seen systems that allow citizens to put forward laws to parliaments using banking details to validate individual supports (voters) for a given legislative proposal.

Governments broadly keep these systems at arms length, retaining the discretion to ignore these votes where they choose, for whatever reason they see fit - and fair enough, these systems are often flawed electorally, representing specific groups, can be prone to some level of gaming and don't have the same level of scrutiny as a formal government-run electoral process.

However the technology now exists for this to change - and it already is, beginning in Hong Kong.

In June this year two legislative steps by China were seen in Hong Kong to weaken the 'One country, Two system' approach that the city had been operating under since reunification with China.

As a result academics and citizens of Hong Kong started the ‘Occupy Central with Love and Peace’ campaign, which involved the non-violent occupation of the main business district of the city with the goal of achieving universal suffrage for voting in time for the 2017 election of the next Hong Kong Chief Executive.

Attached to this process was an unofficial city referendum which took place from June 20th – June 29th 2014. The poll asked two simple questions: which proposal for universal suffrage would you like to see implemented in Hong Kong and should the legislative council adopts an universal suffrage system if it does not abide with the international definition?

This was held outside (and without the support) of Hong Kong's government by citizens, involving online, mobile and physical voting at 20 'pop-up' polling booths set up across the city, with all Hong Kong residents aged over 18 eligible to vote.

While there were official efforts to prevent the referendum, including a large scale attack on the referendum website, the confiscation of voting boxes by Chinese officials and censorship of mentions of the referendum online by Chinese authorities, these did not prevent large scale voting by citizens.

At the end of the ten day process, 798,000 residents had voted - over 20 per cent of the eligible population. Most had voted via the mobile apps, with the second most popular way being online.

Despite the turnout, the Hong Kong government took the view that civil referendums had no legal standing under Hong Kong law, and therefore the result could be ignored.

This led to the largest public protest in Hong Kong since 2003, with over 500,000 people taking to the streets on July 1st 2014.

This type of unofficial civil referendum, where citizens get together to develop robust electoral systems and use them to state a view to a government, is possible today in much of the world.

The notion that voting systems are the province of governments, that only a central jurisdiction can manage a fair national electoral approach, simply no longer holds true.

So while citizens may choose to allow governments to manage these systems, it is feasible to outsource them - on a case-by-case or a permanent basis, detaching electoral processes from the individuals and groups seeking power.

In the future we may see more populations hold their own civil referendums on government policy or on who governs them.

While governments might decry these as illegitimate, as they are not covered within the laws that parliaments have created, these civil electoral processes may indeed be more legitimate in the long run - as the voting process and system are not designed or modified at the whim of those who hold power.

Indeed it will be interesting to see how the government of an advanced democracy reacts in the face of a civil referendum. Even if they deny the legitimacy of the process, they may find it hard to ignore the democratic backlash.

The importance for government of respecting open source and open data copyrights

An interesting situation has arisen in Italy, with the country's Agenzia delle Entrate, the Italian revenue service and taxation authority, accused of copying OpenStreetMap without respecting the site's copyright license.

As documented on the Open Street Maps discussion list, Italy's OpenStreetMap community discovered a little over three months ago that the maps used by the Agenzia delle Entrate in the website of the Italian Observatory of the Estate Market (housing market site) closely resembled those from OpenStreetMap.

In fact, they were able to establish that the Agenzia delle Entrate had copied data from OpenStreetMaps, then superimposed other data on top.

Now given OpenStreetMaps is an open source project, crowdsourcing the streetmaps of the world, that shouldn't normally be a problem.

OpenStreetMaps' data is freely available to copy and reuse - that's the entire point of it.

However there was one factor that the Agenzia delle Entrate had ignored. That the copyright license to freely reuse OpenStreetMap data came with one condition - to credit the source.

Using a Creative Commons by Attribution license, which is also the default copyright for Australian Government information, OpenStreetMaps required only one thing of organisations and individuals reusing their data - to provide an attribution back to the source.

This the Agenzia delle Entrate had failed to do.

OK - this isn't a big issue, and the folk in Italy's OpenStreetMap community weren't that worried to start with. They simply emailed the agency to ask it to correct this omission.

No reply.

Three months later - with no formal response from the agency, and no rectification of the copyright on the site, the OpenStreetMap folk stepped up their criticism.

They created a website where Italians and others can view and compare OpenStreetMap with the Agenzia delle Entrate's site to see how the Italian government agency has violated copyright for themselves.

It's in Italian (naturally), so if you don't read the language an online translation tool can help, but isn't required to compare the maps.

I suggest that visitors use the search tool in the left-hand map to find 'Milan', which is the city recommended for comparison purposes. Note that the agency took its copy of OpenStreetMap a few months ago, so is not as up-to-date as OpenStreetMap itself.


The situation has grown from a simple omission into an active campaign, not only because the government agency ignored the community concerned, but also because that community now feels that if the government is prepared to ignore copyright requirements so blatantly, how is any other copyright in Italy safe.

Essentially if a government agency won't do the right thing when reusing intellectual property, why should businesses or individuals trust them - or do the right thing themselves.

It's something that every government agency should ponder.

What happens to governments when the trust disappears?

It's difficult for governments to remain effective when the support of citizens evaporates. History is littered with failed states, civil wars and insurrections resulting from society's loss of trust in their rulers and governance systems.

In authoritarian states this support is often built on fear, coercion and control, which can prove to be very fragile when citizens lose their fear of a government, as Libya, Tunisia, Egypt and Syria have most recently demonstrated.

Whereas in democratic states support is given willingly based on a covenant that governments will do the best for all in society and citizens will follow laws on the basis that they are applied equally. When these covenants break down, they tends to do so more gradually and over a longer period of time, with a gradual loss of support as governments become more selective in who they govern for and institutions are eroded through partisan appointments, corruption and budget cuts.

However the end result can be similar, as Thailand, Zimbabwe, Somalia and Fiji have demonstrated, with civil war, authoritarian takeovers or societies completely breaking down.

It can take much time for societies to recover from these breakdowns, with economic loss, insecurity and often deaths before a state regains its feet.

Right now we appear to be living in a time of low trust in governments and many institutions, including public services around the world.

Globally the Edelman Trust barometer for 2014 recorded a 4% decline in overall trust in government from 2013 to 2014 (refer slide 23 in the deck) - with particular falls in the US, France and Hong Kong.

This has also been documented in US studies, where trust in the Senate is at only 7%, at 29% for their House of Representatives, and trust in the President's office in decline.

Australia saw an increase year-on-year in the Edelman Trust Barometer, however this wasn't evident in the latest Essential Report (1 July), which roughly annually assesses people's views of government and different institutions.

With an error of +/- 3% at a 95% confidence interval, the survey suggested that 31% of citizens trusted the Commonwealth Public Service, 25% trusted the Federal Parliament and only 12% trusted political parties.

Local councils did marginally better than any of the above groups at 33% trust. State governments were more trusted again at 39% (Queensland) up to 54% (NSW).

Also according to Essential, only 31% of people trusted the government to responsibly use any information collected and held about them.

Now these are numbers in isolation, what's more interesting is a trend over time.

Unfortunately Essential has only been polling on these topics for a few years - with some institutions (such as local councils) only starting last year, so it's hard to form an impression as to whether trust is increasing or decreasing in the longer-term, though many have seen short term declines in the last year.

Of particular note is the decline in trust in the Commonwealth Public Service, which has plummeted from 49% in 2011 to only 31% in 2014.

This is a 50% decline in only four years and should worry all senior public servants.

A lack of trust can lead to difficulties in sourcing information for policy creation, in getting the right people to contribute to shaping policies and can raise difficulties in implementing programs as communities ignore or distrust communications from the government.

Adjunct to this is the low ongoing trust in political parties, which has probably contributed to the high number of independents and minor parties elected in the last two federal elections. In fact a quarter of the seats in the current Senate are held by non-major parties, the highest proportion in our history.

This also contributes to difficulties in passing laws (as we're seeing already) and can lead to parliamentary paralysis. While the government of the day does have the ability to request a double dissolution election with the right trigger (which is already in place), its unlikely a government will do this unless they believe they can improve their position, which isn't the case right now according to opinion polls, and based on the trend appears to be getting less likely by the week.

At the same time we've seen a change in how Australians perceive democracy as a form of governance, with New Matilda recently covering Lowy research which suggests that, "Democracy No Longer On The Nation's Radar".

The research has been conducted for ten years and has shown a growing disillusionment with democracy in Australia. As reported by New Matilda,
"only 60 per cent of the Australians Lowy surveyed believed that “Democracy is preferable to any other kind of government”. By contrast, 24 per cent of Australians held the opinion that “In some circumstances, a non-democratic government can be preferable.” Another 13 per cent felt that “For someone like me, it doesn’t matter what kind of government we have”

For Generation Y respondents the figures were even more striking, with only 42% of respondents preferring democracy.

While these levels of trust in our system, politicians and public service are not yet critical, they are definitely concerning and need to be understood, monitored and causes addressed appropriately.

That leads to the next point - the causes of low trust in Australia and around the world.

I've blogged previously about how the internet is a contributing factor to this trust issue. People are able to rapidly share information, expose falsehoods and politically and socially organise more rapidly than ever before, and this has a material impact on how nations conduct their affairs.

I don't think many governments have yet internalised the impact of the internet on their political and governance behaviour, and this is costing them respect, lost time and effort.

The push for open government, which has stalled in Australian political circles (even going backwards in some areas in the last year), is a reaction to governments seeking to control information flows, even online, and generally failing due to failures to adjust their culture, regulations and behaviours to operate effectively in a digital society.

More openness is good for governments - provided they have thick skins, are prepared to accept criticism and are equal to the task of transforming both political and governance institutions into more engaging and effective communicators.

Without this transformation, governments are increasingly scoring own goals - damaging their political and governance credibility through secretive decision-making processes and decisions that are either or both poorly conceived and poorly communicated.

The 2014 Budget is a case in point - the government followed an 'old school' approach to leaking and preparing the public and then did the normal TV, radio and in-person select appearances to 'sell' it to citizens. However there was no real attempt to engage citizens online, through the social channels where the public were forming and hardening their views even before Ministerial media releases were published in newsprint.

Unfortunately we're still seeing the same behaviour repeated again and again - with government Ministers and agencies attempting to shutdown conversations they don't want by refusing to speak, an old-school approach which is based around government being the main source of information. Now, however, the community is willing to fill the gaps, so these conversations simply don't end - leaving government looking increasingly silly and ineffectual as the only silent group in the room.

This behaviour will contribute to further erosion of trust in institutions, and government agencies who do it to protect their Ministers are having the exact opposite effect - harming Australia's governance system in ways that may prove, over time, to be irreparable.

Governments are also scoring own goals through some of their decisions, which are only damaging the political estate further.

With all of this currently going on I am increasingly worried about the damage being done to Australian democracy and wonder whether it will be reversed before we see irreversal damage or the demise of one, or both, of our major political parties.

Through all of this I hope that the integrity and performance of the public service, recently rated one of the best in the world, is sustained, so that Australia will have the governance structures, expertise and dedication to rebuild trust in the systems we rely on to remain one of the happiest, most secure and wealthiest nations on earth.

It's nice to see government agencies share with each other

One of the most frustrating and, I think, silliest things I found when working in Australian government agencies was how almost every department, agency and statutory body developed almost all of its own policies, procedures, software and tools.

There was often 'undercover' sharing - where people in agencies would ask their colleagues in others for copies of their whatever policy, so they could craft one just like it - however there was no central repository where public servants could go and browse standard templated policy documents or access software code developed by other agencies to resolve certain common issues.

At one stage I actively looked at building a research directory for government - either from within an agency, or as a third-party site - where public servants could list the research their agencies had undertaken and the research they needed to access or undertake, so that it could be effectively shared between departments, saving money in re-running research and informing policy decisions.

This attempt didn't get off the ground as senior management strongly felt they had no obligation to share information on the research work conducted with 'THEIR' public dollars with other agencies - even the fact that they'd undertaken it in the first place.

Fortunately most of those senior managers have now retired (literally), and the new crop coming through are realising that, cash and time constrained as they are, that fighting over which agency 'owns' a specific policy, custom software or research that they commissioned gets in the way of productivity, efficiency and cost-effectiveness.

One of the outcomes has been the latest Australian Government whole-of-government website, GovShare.

GovShare had been talked about for nearly five years and has now finally arrived as a central location for agencies to share their work with other agencies to build standardisation and save money across the public service.

As the About page states, GovShare has been designed to support and promote collaboration across the Australian Public Service, and as an online resource it has been provided to APS agencies and their staff to:

  • publish, discover and access a broad range of artefacts used within the APS, such as frameworks, guidelines, policies, standards, architectural models, open source software and a host of other ICT and business artefacts; 
  • explore APS ICT services and solutions through the Agency Online Services Database and Agency Solutions Database; 
  • find skilled people across the APS with expertise in particular fields or products; and 
  • contribute to online discussions using the forum.

This type of sharing helps save money and time in government. It allows agencies to collaborate to design the best possible policies, guidelines and software and then customise it if needed for their specific needs.

While the benefits of the site won't necessarily be clearly visible outside of government circles, the efficiencies it will support will help agencies focus their resources on achieving the goals of government rather than on endlessly recreating the policies already in place elsewhere in government.

The site already contains nearly 2,000 'artefacts' for review, reuse and adaptation, and hopefully over the next few years this will swell as more agencies become active contributors as well as takers from the site.

It will also hopefully expand beyond its ICT roots into other business areas - allowing agencies to share standard communication strategy templates, HR policies, procurement guidebooks and financial guidelines - tools and resources that help public servants understand and abide by the rules the government sets in these areas.

Hopefully the site will expand beyond federal government as well, bringing state and local into the fold. These governments often face the same challenges, often with fewer resources, and GovShare could have a large role to play in reducing costs at all levels of government in Australia.

Ultimately it would be wonderful to see 'packages' of policies and guidelines that a newly created agency or statutory body can simply pick up, adapt and use for their operations.

This would be similar to the 'agency on a USB stick' concept that I've been talking about for several years around a set of software platforms and settings that would allow an agency to put in place a solid set of operational systems in a very short time.

However it is, as yet, early days for GovShare. Its success relies on three things, ongoing support from the department hosting it (Finance), active participation by agencies in 'gifting' their work to a common store for other agencies to access and the political will and nous to not kill the program before it bears fruit.

I hope Govshare will succeed, and think the omens are good. Its journey over the next five years will be interesting to watch.

For a truly open parliament, look to the UK

The UK Government has just released the alpha version of data.parliament.uk - - a site designed to host open data on the UK Parliament and its proceedings.

(An Alpha for those who don't understand the term is a first release of a software product that is usually tested only by the developers).

The site represents a new frontier for parliaments - making information on the discussions and deliberations of politicians far more actively available in ways that it can be reused to inform the public.

The site is sparse at the moment - only a few datasets on parliamentary questions, on how MPs have voted (something we don't publish in Australia despite it being common data available in North America and Europe) and briefing papers.

It will be interesting to see how it grows in form, function and data and whether it becomes a truly useful source for citizens.

How important really is open government to Australians?

The United Nations is currently running a very interesting global consultation asking people about the six issues that matter most to them.

Named myWorld2015 (vote.myworld2015.org), the consultation has attracted over 2.1 million responses from around the world.

Of these, there have been 14,896 responses from Australia (viewable through the data page) - and it is very interesting to see which issues the Australian respondents have put as the most important to them.

The 'usual suspects' are at the top of the list, a good education, access to clean water and sanitation, protecting forests, rivers and oceans and affordable and nutritious food.

Here's where it gets interesting.

The issue that comes fifth for Australians is "an honest and responsive government".

This issue rises to 2nd when looking at male Australian responses, and falls to 6th position when looking at female.

It is the most important issue for Australians aged over 61, ranked third for Australians aged 41-60, 5th for those aged 16-45 and 6th for those aged 15 and under.

Now I should note there's 16 issues to choose from and the only other issue directly relating to government is "political freedoms".

This ranks much lower - 11th for all Australians.



So what can be drawn from this data?

Australians do feel that "honest and responsive government" is a relatively important issue for them - less important than the environment or education, but more important than better healthcare, protection from discrimination or action on climate change.

Wrapped up in this is the notion that governments act in a truthful and upfront way, that they are accountable, transparent and, to some degree at least, open.

So if any Minister or senior public servant questions the value of open government, point them to MyWorld2015 and the views of nearly 15,000 Australians.

It might help them change their mind.

Are you prepared for Australia's new privacy law?

Today Australia's new Privacy law comes into force, affecting Australian Government agencies, businesses with a turnover of more than $3 million or trading in personal information and all private health service providers.

As the first major change in Australian privacy law in 25 years, there's been numerous changes and updates to reflect the major changes in society over this period.

Since the last Privacy Act was introduced in the late 1980s we've seen the digitalisation of most records, the introduction of the world wide web, the rise of Web 2.0, the spread of mobile devices and the greatest increase in public expression by Australians in history.

The notion of privacy has also changed. I've always considered privacy as a transaction rather than an absolute - people trade aspects of their privacy in return for services, benefits or convenience. This has become far more widespread as an approach as organisations increasingly use personal information to shape peoples' experience of products and services, particularly online.

Generationally we've seen very different views of privacy take hold. Younger people are far more willing to share information that their elders consider 'private' and have new concerns around information that their elders share without a thought.

The new Privacy law (Privacy Amendment (Enhancing Privacy Protection) Act 2012) contains a number of stronger provisions on organisations to protect and communicate how they protect the privacy of individuals, as well as more ability for individuals to ask organisations what they know about them.

It also does a great deal to revalue personal privacy. Whereas Telstra was recently fined about $10,000 for accidentally releasing private information on about 12,000 people - valuing their privacy at 0.83c each, under the new law the penalties may be much higher - up to around $1.7 million.

If you're unfamiliar with the new privacy law, you're probably in the majority.

There's been little promotion of the change and limited information available for the public or organisations to test their current privacy approach.

There is a media release on the Office of the Australian Information Commissioner's (OAIC) site and the OAIC has done what it can - without a significant budget - to get the word out to those affected by the changes.

Unfortunately the changes haven't been promoted by any Ministers or the Prime Minister - the law was changed under the last government and the ownership may not be there.

However regardless of the promotion or not of the new law, it is now in effect. Every Australian has new rights and many organisations have new obligations they must meet in collecting, holding, sharing and protecting the private information of Australians.
